伊斯兰民法之基石:土耳其与埃及民法典

《土耳其民法典》与《埃及民法典》是中东伊斯兰国家法律现代化进程中的两部代表性民法典。虽然近现代以来两国都移植借鉴了西方民法,但是两国的民法典却存在明显差异,相应地形成了中东地区民法典的两种模式。《土耳其民法典》坚持全盘西化,《埃及民法典》则试图在传统与现代间进行调和。由于伊斯兰法律文化与西方法律文化间难以弥合的差异,中东伊斯兰国家学习、借鉴西方的法律现代化之路注定不平坦。

Civil code of Turkey and civil code of Egypt are two representative civil codes in the Middle East. But since modem times, the road of modernization of civil law chose by the two countries are different. Although the two countries transplant Western civil code in some degrees, Civil Code of Turkey insists westernization, while Civil Code of Egypt is trying to reconcile between tradition and modernity. As everyone knows, Islamic legal culture and Western legal culture are different, so the modernization road is destined difficult for the Islamic countries learn from West.
