审判管理何以可能——以“大日子”涉诉信访为例

How Can Trial Management Be like this?-Taking "Xinfang of Litigation" in Big Day as an Example

当前审判管理工作的重点是要对审判质效和审判绩效进行科学考评,以确保司法公正、廉洁、高效。"大日子"涉诉信访现实地存在于我们的司法体制中,其所涉的许多案件都与政策和立法关联很深,并常常打破司法规律,对审判管理产生着很大的影响。无视这种影响,审判质量管理所要求的立案率、上诉率、申诉率等指标便难以达成,审判效率所要求的收结案动态平衡会很难实现,依托于审判质效管理的审判绩效管理也无法运作,反而有被刻意迎合和被架空的危险。应该淡化"大日子"的影响,择机废除涉诉信访,及时修正审判质效评估体系和审判绩效考评指标,使我们的司法能够稳定地、循序渐进地发展。

The key to trial management is scientific evaluation of trial effect and performance in order to guarantee justice, integrity, and efficiency of Judiciary. The ＂ Xinfang of Litigation＂ in big day does exist in our judiciary and its existence breaks judicial rules and makes relevant cases related to policies and legislations. This practice is harmful to trial management. If we ignore the influence, the rate of case filing, appealing and petition which trial quality management asks will be hard to achieve, the active balance between case filing and case settling which trial efficiency asks will be difficult to realize, and the performance management based on effect management will not be operated. Furthermore, all the index of management will be in danger of catering for and off foundations. We shall try to weaken the influence of ＂ big day＂ , seize a chance to abolish the ＂ Xinfang of litigation＂, and correct the evaluation system in time so as to develop our judicial system in a stable pace step by step.
