精神损害赔偿不适用于违约责任是传统民法理论的主流观点。本文通过文献整理,结合典型案例的司法实践,提出了我国建立违约精神损害赔偿的制度依据和建构规则。在司法实践中,违约精神损害赔偿应从严掌握,避免滥用。

The traditional civil law theory insists that the liability for breach of contract does not apply to spiritual damage compensation. Through literature review, combined with judicial practice case, the paper proposed the basis and construction rules for establishment of spiritual damage compensation system in breach of contract. The paper emphasized that, in the judicial practice, spiritual damage compensation in breach of contract should be controled strictly to avoid abuse.
