论中韩、中日渔业协定框架下的传统捕鱼权保障

On the Protection of Traditional Fishing Rights under the Framework of China-Korea and China-Japan Fishing Agreements

中韩、中日渔业协定生效均已逾10年,为了执行协定,我国失去了大面积的传统作业渔场,并由此导致近海渔场压力剧增,资源与环境承载不堪重负。身处国家义务困境之中的传统渔民前进无门,后退无路,生产生活遇到重大困难。在国际海洋管理新秩序已经确立,周边国家海上执法日益严苛,岛屿争端、海域争执日趋激烈的背景下,加强对传统捕鱼权国家义务困境的研究具有重大的理论价值和现实意义。应深入分析困境产生的源起、科学剖析困境久拖不决的深层次原因,进而结合我国渔业生产特点采取有针对性的措施,积极寻求困境解决路径,保障传统渔民的合法权益。

China has lost large areas of traditional fishing grounds after the implementation of the China-Korea and China-Japan Fishing Agreements for more then a decade. As a result,China's offshore fishing grounds were so crowded that the resources and environment was overburdened. The traditional fishermen in the national obligation plight faced great difficulties in production and living. It has great theoretical value and realistic meaning to strengthen the research of the national obligation plight of the traditional fishermen maritime right under the new order of the international ocean management. It would be helpful for the protection of the legitimate rights and interests of traditional fishermen to deeply analyze the reason of dilemma and then to seek the solving path according to the characteristics of Chinese fishery production and the fact of the traditional fishermen.
