赖以构造法律理论的智识资源并未穷尽。以符号学的视角来看,法律恰恰是符号性时空,有其固有的节奏、以特定逻辑容纳生活世界中的真实。法律这个符号性时空由符号创造和符号运用两个领域构成,深藏在符号创造和符号运用内里的则是权力运作。法律由此呈现出完全的符号行为和半符号行为两种形态,此中内含着复杂的法律价值领域的"最大公约数",即"通过符号以理性与审慎地相互对待"。此堪可称为"法律以符号型塑生命"。然而,法律在以符号型塑生命从而屏蔽了生物性-物质性的不平等后,适造成行为人的符号性不平等,即符号能力的不平等。法律由此难以摆脱其不合目的性。

The intellectual resources constructing legal theory have not been exhausted. From the semiologic point of view, law serves precisely as a symbolic space - time continuum that contains reality in the living world with its inherent rhythm and its specific logic. Law, as a symbolic space - time continuum, is composed of symbolic creation and symbolic application,in which hides the exertion of power. Hence, law presents itseff as symbolic action and semi - symbolic action, which contains the complicated＂ greatest common divisor＂ of the value of law, that is,＂ to treat mutually with ration and cautiousness via symbols. ＂This could be considered as＂ law shaping life with symbols＂. Nevertheless, after law shapes life with symbols and thus shields the biological as well as physical inequality, the symbolic inequality, or to put it another way, the inequality of symbolic ability emerges. It is difficult for law to get rid of unpurposiveness therefrom.
