摘要
婚姻法 (修正草案 )还有许多不完善和值的商榷的地方 ,作者提出了如下几点修改意见 :1.增加家庭关系、特别是家庭成员间财产关系的规定 ;2 .无效婚姻应当完善宣告制度 ;3.修正夫妻财产约定后的债务清偿问题 ;4.修改“抚养”为“共同生活”,使法律规定更加准确和完善 ;5 .
In the thesis, the author brings forward some suggestions on the modification of Marriage Law: 1. to add provisions about property relation between family members; 2. to perfect avoidance system of invalid marriage; 3. to correct debt discharge means with conjugal property stipulation; 4. to revise “foster” into “live together”; 5. discussion on legal words.
