Research on the Subject of Product Liability

产品责任主体分为权利主体和义务主体。产品责任的权利主体是受到产品缺陷损害的—切受害者 ,包括自然人、法人和其他组织。而产品责任的义务主体主要是产品的制造者、销售者 ,在特殊情况下 ,还包括原材料、零部件的制造者 ,但不包括产品的设计人、运输者。

Subject of right and obligation constitute the subject of product liability. Subject of right refers to those who suffered injuries from the defect in products, including natural person, legal person and other organizations. Subject of obligation refers to those who have manufactured or sold the products, under the specific circumstances, those who manufactured the raw and processed materials, not those who have designed, delivered or stored the products and those sufferers.
