基于对劳动者合法权益的保护 ,劳动合同制度可 :1 区别对待事实劳动合同的效力问题 ;2 为了实现实质公平 ,立法设立单方可变更、可撤销劳动合同制度 ;3 把劳动合同解除作为终止的一种形式 ;4 违约金不宜作为违反劳动合同的责任方式 ;5 培训费是否全赔进行具体分析 。
Determining effect according to difference factual labour contracts so as to protect labourer interest.Achieving changeable and removable labour contrast law so as to accomplish particular fairness.Labour contract's removing is a kind of its ceasing.Punitive fine isn't made of law liability of breaking labour contract.Training cost will be detemined by facts.Salary must be paid instead of punishment.
