摘要
法律传统研究中的四个基本理论问题，即法律传统的概念、特性、结构、功能，有必要进一步研讨。法律传统是指发源于过去、存在于现在并在一定程度上影响未来的法律文化。法律传统具有群体性、优势合法性、历史延续性和可变性四个基本特性。法律传统是由物质层面、制度层面、观念层面、行为层面的法律文化构成的。法律传统在法律实践与法律发展中具有积淀、指引、整合、定向四种功能。
The four basic theoretical question-concept, traits, structure and functions of legal tradition need further study and discussion. Legal tradition refers to any legal culture originating from the past, existing in the present and functioning in the future. It has four traits: collectiveness, legitimacy, continuity and changeability. It includes material, institutional, spiritual and behavioural legal culture. It has accumulative, indicative, integrative and directive function in the practice and development of law.
