The Merits and Demerits of the Court's Altering Accusation and Condemn Directly

法院变更指控罪名直接定罪的合理之处有利于处罚犯罪和提高诉讼效率 ,但这种做法有违我国刑事诉讼法的基本原则并有悖司法公正。这表现在 :它侵犯了被告人的辩护权 ,违背了“分工负责、互相配合、互相制约”的宪法规定。司法实践中需要变更指控罪名以正确适用刑法时应该经过合法程序。

The merits of the court's altering accusation and condemn directly is that it is helpful to punish the criminals promptly and promote suit efficiency.But it violates the basic principles of the law of criminal proceduer in our state,and contradictory to judicial justice. The demerits lies in: it violates the right to defense of the accused, and goes against the constitutional provision which stress`responsibility according to division of labor, coopreation with each other, condition each other'. In judicial practice, if it is necessary to alter accusation in order to applying the criminal law correctly, it must be through legitimated procedure.
