论公务员的含义与范围

On the Meaning and Category of Civil Servant

国内外不少学者对公务员的含义和范围进行过较为广泛和深入的探讨，这些探讨具有积极的意义，但结论却不尽人意，未能深刻揭示公务员的内涵和外延。笔者认为，只有把握了公务员的本质特征，才能将公务员这种国家公职人员与其它国家机关的公职人员区别开来，才能很好界定公务员的内涵和外延，进一步明确国家与公务员的关系，使公务员的权利得到切实的保障，公务员的权力得到有效的制约。

Though many scholars, domestic and overseas, have been studying deeply and extensively the meaning and category of civil servant and have made constructively meaningful explorations, their conclusion still cannot reveal the meaning and category of civil servant, thus being unsatisfactory. The author holds that only when the characteristic essence of civil servant is grasped, can civil servant, the government employee, be differentiated from employee in other state organs, and can the meaning and category of civil servant be defined. Thus the relationship between the state and the civil servant can be cleared out, the tights of the civil servant can be guaranteed practically, and their power can be restricted effectively.
