摘要
从投资法角度研究知识产权保护具有重大意义 ,因为作为无形资产的知识产权是跨国公司相互之间以及国家之间经济竞争的重要筹码 ,是国际投资的重要组成部分 ,国际投资的迅猛发展离不开知识产权的法律保护。在国际投资自由化和全球经济一体化的要求下 ,知识产权保护已经日益成为国际投资立法的重要组成部分 ,在各国外资法、各种双边投资条约、区域性投资条约和全球性投资条约中 ,知识产权保护条款占据了和正在占据重要地位。知识产权保护水平的高低和知识产权保护规则的健全与否 。
This paper endeavors to make a comprehensive,systematic and objective study on the issue of important status of the protection of intellectual property rights in all kinds of investment laws.The author maintains that it is important to study the issue of intellectual property rights from the perspective of international investment law,because intellectual property rights are not only key weapon in the international competition between transnational corporations and countries,but also the important component of international investment.To meet the need of international investment liberalization and to improve the international investment environment,we must strengthen the protection of intellectual property rights in international investment legislations.
