论涉外产品责任的识别与法律适用范围

On the Distinguishment of the Responsibility of Foreign Products

随着国际贸易的不断增长 ,各国商品在国际范围内的广泛流通 ,产品侵权问题已经超过了国家的界限 ,引起了各国对涉外产品责任的研究和法律界定。由于各国产品责任法内容规定的差异 ,法律冲突不可避免。本文从冲突法研究的角度对涉外产品责任的识别及法律适用问题加以浅析并提出了建议。

With the development of the international trade,and the extensive circulation of the products among the countries,the problem of product infringement is beyond the boundary of the countries.This leads to the research of the responsibility of the foreign products.Due to the difference of the product responsibility in the world,the law conflict is unavoidable.A new light is shed on them in this essay and some ideas are indicated here.
