引进先进技术是我国举办外商投资企业的主要目的之一。为了维护国家利益和中方投资者的合法权益 ,必须对外方的技术出资加以规范。从技术出资的条件、出资技术的所有权、技术出资的担保和技术评估与作价等方面探讨有关法律问题 。

Introducing advanced technology is one of the principal purpose for initiating foreign merchants investment enterprises . In order to defend national interests and the legal rights of Chinese investors,we have to standardize the technical investment from abroad.In the article the author explores on the conditions of offering capital, ownership of offering capital by technology、guarantee of technical investment and technical appraisal and fix a price on technology and so on.Then pur forward the suggestions for further standardizing the act of technical investment from foreign merchants.
