中国电子签字的立法思考

Thoughts of Legislation on China's Electronic Signature

世界上已有数十个国家和地区制订了电子签字单行法律或有关法规、政策，我国则仍在有关立法中回避了电子签字的问题，学术界也未曾对电子签字的有关问题进行深入的研究或探讨。在联合国贸法会《电子签字示范法》即将出台之际，本文作者联系我国电子商务发展及立法现状，对电子签名提出了单项立法的建议，并对其中涉及的问题提出了相应的意见。

Many countries and regions in the world have already made separate electronic signature act and relevant legislations or policies. However, the relevant legislations of our country has evaded electronic signature, while the academic circles hasn't yet deeply researched or probed into the issue of electronic signature. On the eve of the publication of UNCITRAL Model Law on Electronic Signature, this paper brings up some suggestions of making separate act on electronic signature and points out some relevant opinions according to the development of China's E - commerce and her current legislation situation.
