新合同法的效力范围

The Concerning Extent of the New Contract Law

新合同法是调整交易关系的法则，其横向效力范围包括债权合同、物权合同、主体性合同、无名合同等等国内合同与涉外合同；其纵向效力范围，一般不具有溯及力，但在一定的情况下具有溯及效力；应加紧原合同法法规、规章的清理工作，做到新合同法与原有合同法规范体系的协调。

The new Contract Law is a sort of rule adjusting relations of trades. Its concerning extent horizontally includes the contract of creditor's rights, owner's rights, subject and namelessness, etc, concerning all kinds of internal and external contracts. Its vertical concerning extent has no ability to trace to the former cases before the new Contract Law going into effect but some conditions. So some work should be done to unite the new and old contract laws to form a perfect law system.
