摘要
不动产双重买卖是否有效 ,学术界历来有争议。不动产双重买卖并非法律所禁止行为 ,但债权人 (先买受人 )在一定条件下可行使撤销权。撤销权行使之后果是使债务人(出卖方 )的双重买卖行为自始无效 ,债务人已失之财产又恢复原状 ,复归于其 ,从而债权人可达到追回不动产之目的。
There have long been disputes in the academic circles over real estate dual sales. It is recognized that although real estate dual sales are not inhibited by law, the creditor (prior purchaser) could, under certain conditions, enforce the right of revocation. When such enforcement takes place, the action of the debtor (seller) becomes invalid from the beginning and the property which the debtor has lost should be restored to the debtor. Thereafter the creditor will regain the real estate.
