论法治的道德基础

On the Moral Foundations of the Rule of Law

伦理道德价值的定位与指向 ,决定了法治的模式选择、具体内容、表现形式及终极目标。在法治与德治问题上 ,应二者并重 ,法治是手段 ,德治是目的。

This article proposes that the location and target of the moral value decides the models,contents,forms and objectives of the rule of law .The rule of law and the rule of morals are both important in the state,the rule of law is the means and the rule of morals is the aim in the ideal society.
