论检察官的客观义务

On Objective Responsibility of Prosecutors

检察官在刑事诉讼中承担客观义务有利于实现司法的公平和正义。我国立法也对检察官的客观义务做出了多方面规定，但受近年流行的对抗制精神的影响，我国许多检察人员只注意履行自己的控诉义务，而疏于履行自己的客观义务。为改变这种现状，有必要对我国的立法和实践作相应改革与完善。

It is beneficial to achieve fairness and justice for the prosecutors t o assume the objective responsibility in criminal procedure. Our legislation has made much prescription on it. But under the influence of the popular spirit of adversary trial system in recent years, many prosecutors perform their prosecuti ng responsibility attentively, but neglect their objective responsibility. In or der to alter the condition, it is necessary to make relevant reform and improvem ent with the legislation and the practice.
