Study on Crime of Releasing Personnel in Custody without Authorization

本文首先论述私放在押人员罪构成要件中所涉及的几个问题；然后对与本罪认定相 关的问题诸如罪与非罪、既遂与未遂、特殊情形的认定以及此罪与彼罪的界限进行分析探讨；最后论及本罪的处罚问题。

First, this article discusses some questions related to the Constituti ve requirements of the crime of releasing the personnel in custody without autho rization; then analyses and probes into such questions relevant to the determina tion of the crime as crime or no crime; accomplished offense or attempted offens e; special circumstances and the differences between the crime and other crimes; finally discusses the penalty of the crime.
