关于我国死刑立法完善的若干问题探析

Discussion on Several Issues in the Legislative Perfection of Chinese Death Penalty

立足于我国的实际国情，现阶段废除死刑是不现实的，但从世界发展趋势来看，尤其是我国已签署了《公民权利和政治权利国际公约》，限制死刑是大势所趋。与《公民权利和政治权利国际公约》相比较，我国刑法中的死刑立法在适用范围、适用对象、死刑复核、死刑的限制、执行方面还有一定的差距，亟待完善，应争取早日与国际接轨。

Based on our present situation, it is not realistic to abolish the death penalty in recent years .But from the developing trend of world , especially P.R.china signed the International Covenant of civil and Political Rights , it is undoubtedly that death penalty should be confined. Compared with the covenant, there are some shortcoming in the death penalty legislation of Criminal Law .Starting with the International Covenant ,the article discusses the legislative perfection of chinese death penalty.
