诱惑侦查的存与废及价值取向浅析

Analysing the Retaining and Abolishing of Police Trap and Its Value-orientation

诱惑侦查这种特殊侦察手段的存废问题争论已久，“存在说”与“废除说”均有自己的理由。但实际上，这个问题的讨论不能简单化，应在追求正义的前提下，一方面使诱惑侦查这种有效的侦查措施继续存在，另一方面针对其可能带来的弊端而进行规范，最大限度地降低其负面影响，以兴利除弊。

The arguement about retaining or abolishing police trap—— a special investigative method has existed for a long time. Either“ Theory of Retaining” or“ Theory of Abolishing” has its own arguments. In fact, the discussion on this problem can't be simplified. Under the prerequisite of persuing justic, we should, on the one hand, let this effective investigative measure go on existing, on the other, take measure to eliminate the drawbacks coming with it, thus reducing its negative effect maximally.
