网络服务商在作品传播中的地位

The role of ISPs in the transmission of creative works

互联网的高速发展不仅变革了社会生活和促进了经济发展 ,而且也给传统的法律基本理论带来了极大的冲击 ,尤其是网络服务商作品传播的著作权责任方面 ,更是当前社会关注的一个焦点。本文从网络环境下的著作权立法及司法等几个角度出发 ,分析了网络服务商在互联网环境下作品传输过程中的行为 ,对网络服务商的出版商地位进行了论证 ,初步探讨了网络服务商在著作权法中的地位和所应承担的责任 ,并且在理论上对网络服务商著作权责任的限制进行了尝试性的分析 ,以保护在互联网发展初期尚不成熟时网络服务商的利益 ,促进其积极的发展 。

WT5BZ] The fast development of the Internet not only changes our social lives and promotes the economic development, but also has imposed considerable impact on the traditional fundamental legal theories. In particular, the copyright obligations of ISPs in transferring authorsworks has become a focus of public attention. This article analyzes the behaviors of ISPs in transferring such works over the Internet, from different perspectives including legislation, judicature, etc. It argues ISPsroles as publishers, and discusses the roles of ISPs in copyright law and their obligations. In addition, the article provides an experimental theoretical analysis on restricting the copyright obligations of ISPs, which may be a valuable method to protect the interests of ISPs in the initial development of the Internet, and will actually help the development of the Internet. By this way, the article tries to find the best balance between the development of the Internet and the protection of copyright. [WT4”HZ][
