浅析义务教育法制

On Legal System of Compulsory Education

现行教育法制的理念是教育人权主义 ,基于这一理念和法律规范本身的要求 ,已实施了 15年的《义务教育法》在其结构、目的、依据、法律文本的用语等几方面既有其合理性 ,又有诸多不完善之处。因此 ,我国既有必要对《义务教育法》作相应的修改 ,更需要制定相应的法律、法规加以补充、完善。这是“依法治国、依法治教”的必然要求。

The theme of modern educational legal system is Human Rights Doctrine. Based on the ground and the requirement of legal rule itself, the Compulsory Educational Law implemented for 15 years has its own advantages in structure, aim, ground, the legal version terms, but the law is on the point of being improved. Therefore, the corresponding amendment should be made, and the corresponding items should be supplemented and improved, which is a principal requirement of conducting education according to law.
