构建我国个人破产制度的法律思考

Thoughts on Structuring China's Bankruptcy System

个人破产制度是商品经济发展的必然产物，是维护交易安全，贯彻法的公平价值的保障．在我国建立个人破产制度是经济发展和法制建设的必然要求。我国个人破产的范围应顺应国际潮流采用一般人破产主义。建立个人破产制度必须完善相应的个人财产登记制度、许可免责制度、自由财产制度以及小破产程序制度等内容。

The bankruptcy system of individuals is a necessary outcome of economic development.It is a guarantee for the safety of trade and the implementation of the equity value of law.It is necessary for the development of China's economy and legal system to found a bankruptcy system.We should follow the international trend and adopt everyman-bankruptcy system.To establish the everyman-bankruptcy system,what we should do is to perfect the personal property register system,the obligation exempt permission system,the free property system,and the small bankruptcy procedure system.
