摘要
从黑社会犯罪的定义与特征 ,以及构成黑社会犯罪的标准来看 ,我国现在的有组织犯罪的最高程度不仅仅是黑社会性质组织犯罪 ,而是已经达到了黑社会犯罪的程度。立法应当适应犯罪发展形势的需要 。
The author thinks that the under society in criminal law must be revised and completed, because the organized crime in China is changing to under society crime. The legislation should be regulated.
