摘要
家事审判制度是一种特殊的民事司法程序。在世界各主要国家和地区 ,其家事审判制度相当成熟并各有其特点 ,而我国的家事审判尚未制度化。要建构我国的家事审判制度 ,须制定单独的家事审判程序法 ,设置家庭法院 ,确立履行确保制度 。
The “Family Matters Judging System” is a special kind of civil judicial procedure. This system in many major countries and areas in the world is quite mature and each has its own characteristics. But in China the family matters judging is still not systematic. If China wants to construct this system, it must formulate the Law of Family Matters Judging Procedure, set up family court, establish Implementation Guarantee System and exploit the latent power of the basic_level mediating organizations
