提单应尽量符合UCP500的规定

摘要 提单作为海洋运输中的重要凭证影响着各当事人的责任、风险和利益。由于不同海运公司出具的提单在形式或措词上的不同 ,银行、海运公司等有关机构对提单上记载内容的理解也会不同。在实践中 ,银行对于提单的审核、内容的认同主要以《跟单信用证统一惯例》(国际商会第 50 0号出版物 ,以下简称UCP50 0 )为依据。为避免理解差异所引起的纠纷 ,海运公司和船舶代理公司在缮制提单时要考虑这一事实 ,应尽可能使提单符合UCP50 As an important transport document,a bill of lading is binding on all parties of trade and shipping on respects of their responsibilities, risks and benefits. Various typies of bill of lading(s) with different pre printed words are produced by different shipping companies,then different opinions between banks and shipping companies are produced by understanding and explaining the contents filled in bill of lading(s). As a fact,banks always examine and understand bill of lading(s) according to UCP500. Shipping companies should take this fact into consideration so as to be able to avoid the disputes aroused by different understandings and explainings. Bill of lading(s) should apply to UCP500.
