Two characteristics of the culture of traditional Chinese administrative law and its influence to the modern China

:中国传统行政法文化有两大特征 :第一 ,行政法是“管理法” ,它所关注的是君权、政府权的有效施展和对臣民的有效控制 ;第二 ,行政道德化 ,行政运作过程“人治化”。这两大特征对现代中国行政法文化的建设有重要影响———或者是积极的 ,或者是消极的 ,认真对其剖析、研究可以帮助我们看清现实行政法制建设中存在的问题 ,并借鉴历史上的有效经验 ,建设现代、新型的行政法律文化。

There are two characteristics about the culture of traditional Chinese administrative law.The first one is that administrative law is actually“law of management”,which concerns the effective wielding and control over the subjects of monarchical power and government power.The second is that administration is moralized and the operating of it is “of being personal rule”.These two have important influence——positive,and negative——on the construction of modern Chinese administrative law.A careful dissection of the influence can helps observe the existing problems in practical construction of administrative legal system,use the successful experiencein history,and build a modern new culture if administrative law.
