On Three Principles of Protection for Supervision by Public Opinions

保护舆论监督的关键是新闻侵权的划界问题 ,这有赖于严格的法律界定。保护舆论监督的原则至少应从三个方面着眼 :新闻媒体依法独立行使舆论监督权利 ;有利于维护社会公共利益 ;新闻侵权认定应适用“严格责任”和“公正评论”。

The key to protect the supervision by public opinions is a problem of dividing line of news infringement act, which depends upon strict law boundary. The principles to protect the supervision by public opinions, at least, should include three aspects: news media can have the right of implementing the supervision independently; what they do must benefit the uphold of social and public interests; the identity of news infringement act should rely on 'strict duty' and 'fair minded comment'.
