关于健全我国法官惩戒制度的思考

Reflections on Judge Disciplinary System

法官惩戒制度在保障法官身份 ,制约监督法官行为方面有着重要意义。我国法官法规定的法官惩戒制度很多方面都存在缺陷。我国存在的另一种惩戒法官的制度———错案追究制 ,因其本身的不合理性应予摈弃。对法官的征戒应立足于对行为的控制 ,应立足本国国情 ,借鉴国外经验 ,并制度化。

Judge disciplinary system is very important to ensure judge's status,control judge's behavior.Judge disciplinary system regulated in The Law of Judge of China has many drawbacks.The alternative judge disciplinary system-wrong case investigation system should be discarded because of its irrationality.Judge discipline should be a law and system which based on behavior control,national situation,and experience of foreign country.
