摘要
我国现行担保法及相关理论把抵押合同视为物权行为 ,抵押登记视为物权行为的生效要件 ,这是长期以来的一个误区。我国未来物权立法应采取债权形式主义的物权变动模式 ,在该模式下 ,抵押合同性质应为债权行为 ,抵押登记系独立于抵押合同之外的物权变动要件。对于未经登记的一般动产抵押 。
In the existing guarantee law and the corresponding theories of China,mortgage contract is considered as a juristic act of real right,and mortgage registration is thought to be an essential condition of the act.This theory is the long standing mistaken ideas.In the future legislation of real right,the claiming formalism should be adopted to the mode of the changing real right,and with the mode,the attribute of mortgage contract is juristic act of claim while mortgage registration is an essential condition of the real right changing which is beyond mortgage contract.There is no right to mortgage on the unregistered common movable estate.
