包庇、纵容黑社会性质组织罪研究

A Study of the Crime of Sheltering or Pampering Mafia-ike Groups

包庇、纵容黑社会性质组织罪的构成要件特征是 :犯罪客体为国家机关同黑社会性质组织罪作斗争的正常活动和正常的社会治安管理秩序这一复杂客体 ;客观方面表现为包庇或纵容黑社会性质组织的行为 ;犯罪主体为特殊主体 ,即国家机关工作人员 ;主观方面须出于故意。在司法实践中 ,应准确认定罪与非罪、此罪与彼罪及该罪的特殊形态 ,贯彻刑法典增设该罪的立法精神 ,密切防范和严厉惩治国家机关工作人员包庇。

The requisites to constitute the crime of sheltering or pampering mafia_like groups are as follows:1 The object of crime refers to a complex one,which includes the normal activities of state organs struggling against mafia_like groups and the normal management order of social security.2 The objective aspect stands for the actions of sheltering or pampering mafia_like groups.3 The subject of crime is special,i.e.,staff in state organs.4 The objective aspect must be deliborate.In the judicial practice,we should exactly define crime and non_crime,this crime and that crime,and the special structure of such crime.When adding such crime to the Criminal Code,we must follow such a legislative spirit:closely preventing and severely punishing the offences of staff in state organs who shelter or pamper mafia_like groups.
