摘要
对房屋买卖合同中标的物的风险责任,有以所有权为承担责任的标准和以交付为承担责任的标准两种不同观点,在房屋买卖合同标的发生意外毁损、灭失的风险责任时,应以交付为确定风险责任承担的标准。
There' re two different opinions in the problem of risk responsibility for the subject matter in house bargain contract. Some hold that property should be regarded as the criterion while the others think transfer should be the criterion. The authors discuss that in house bargain contract transfer is the criterion to the judgement of risk responsibility when unexpected loss and damage occur.
