How to Make Use of 《Contract Law》 to Perfect the Agency System of Foreign Trade

新《合同法》颁布之前 ,我国外贸代理制主要由《民法通则》、《对外贸易法》、《关于对外贸易代理制的暂行规定》等三部法规的调整 ,新《合同法》的实施 ,为完善和推行外贸代理制提供了坚实的法律基础。充分利用新《合同法》中的“委托合同”和“行纪合同”立法规定 ,对我国外贸代理制度进行补充和完善 。

Before new 《Contract Law》was promulgated,the agency system of foreign trade in our country had been mainly regulated by the three statutes i.e. 《General rule of civil law》,《The law of foreign trade》 and 《Interim provisions concerning the agency system of foreign trade》.The enforcement of new 《Contract Law》 furnishes the solid foundation of laws for perfecting and pursuing the agency system of foreign trade.By making full use of the regulations of “Trust contract” and “Broker house contract” in new《Contract Law》, we complement and perfect the agency system of foreign trade so as to bring the agency system of foreign trade more in line with international practice.
