On the Socil Material Benefits Relationship Under Legal System

“依法治国,建设社会主义法治国家”已被作为一项重要的治国方略写进了宪法。基于现存的社会主义市场经济的所有制格局,社会主体之间的利益结构体系的重建成为必然。从法律义务而言,不论实现国家利益、集体利益,还是实现个体利益,均不能损害社会利益。因此,在立法、执法等工作中必须正确认识和处理社会利益、国家利益。

Rule the country according to the law and construct socialist law-ruled country'has been put into the constitution as an important general plan to rule the country. Due to the present ownership structure of the socialist market economic ,the reconstruction of the benefit structure system among the social subjects has become certain. So far as legal duty is concerned ,no matter realizing national benefit,collective benefit or individual benefit,social benefit can never be destroyed. Therefore,in the course of the legislation and the enforcementof the law,the relations among social benefit,national benefit,collective benefit and individual benefit must be well understood and properly handled.
