国际政府采购管理规则比较研究

Study on the Rules about National Government Buyment

政府采购是财政管理的重要制度 ,在国际上已被广泛采用 ,我国正在建立和推广过程中。本文运用比较研究的方法 ,分析了当今国际社会最为典型也最有影响的 4部政府采购管理法规 ,即联合国国际贸易法委员会制定的《货物、工程和服务采购示范法》 ,世界贸易组织制定的《政府采购协议》 ,欧洲联盟制定的 6个公共采购指令 ,以及世界银行制定的《国际复兴开发银行贷款和国际开发协会贷款采购指南》 ,围绕主要特点、基本原则、核心规范和竞争措施等方面分别介绍其特征 ,而这些特征综合起来又构成前述任一部国际政府采购管理法规完整的立法精神和基础内容。

Based on the important and widely accepted national government buy, the paper compared the four most effective management rules: The demonstration laws of goods, project and service(UNCITRAL), The agreement on government buyment(WTO), The order of Public buyment(EEC), and The buy guide for loan for international bank of reconstruction and development(WB). This analysis revealed the futures, important rules, based principles and competing measurements, however, the paper proposed the complete sprit and base contents about the national government buy management rules.
