21世纪国际经济一体化与法律协调发展的法哲学思考

A Discussion in Legal Philosophy on the International Economic Integration and the Coordinative Development in Law in 21 Century

经济发展必然带来国际经济法律体系的变化 ,法律的变化与经济一体化协调的基础是一国法律体系的自我完善。对于国家主体而言 ,以规则为基础的国际法体系应当体现自由和平等 ;而对于私法领域的统一化运动 ,应当看到它的两面性 ,即作为文化表层的统一 ,以及作为一国文化特色的法律个性发展。

Economic development certainly has brought about the changes in international economic and legal system, and the foundation of the coordination of legal changes and economic integration is the self perfection of the country's legal system. In terms of the State, the international legal system based on rule and regulation should express freedom and equality; but in the unification of legal series concerning private field, we found out two aspects, one is the unification of the cultures in surface, the other one is the independent development of law with the feature of the country's character.
