经济全球化推动和要求国际直接投资自由化 ,国际投资法在法律管制的渊源、内容、原则上均呈现了放松管制的自由化倾向。然而 ,由于世界经济一体化的进程依然漫长 ,经济全球化过程中仍然存在严重的不平衡现象 ,发达国家与发展中国家在国际投资领域中矛盾仍未得到弥合 ,发展中国家在放松对外资管制的同时 。

There is an increasing demand for a freer environment for international direct investment with the globalisation of economy.The trend of freedom also appears in the origin,content and principle of the law of international investment.Meanwhile,the process of world economy globalisation will be a long period,and there are many phenomena unbalantly developing in the process,and problems between developed and developing countries have not been well solved.So,the right attitude of taking the good and refusing the bad shall be taken by the the developing countries in the process of releasing restrict with foreign capital.
