Historical Evolvement or Reason Constitution--Reflections on the Tradition of Chinese Law and Legal Development

世界各国的法律发展过程 ,大致可分为“经验演进式”和“理性建构式”两种发展模式。中国传统法律思想的缺陷以及中国法治建设的后发性决定了中国不宜走“经验演进式”道路 ,而应走一条渐进的、按阶段进行的“理性建构式”

The development of law in various countries can be generally classified into two patterns: historical evolvement and reason constitution. Because of the weaknesses of the traditional legal conceptions and th e late development of China's construction,China should not follow the way of h istorical evolvement, but follow a gradual and phasal way of reason constitution .
