Comparison of Values between Economic Law and Civil law

民法强调机会公平、经济自由 ,着眼于增加个别交易效率 ,追求个体利益最大化 ;而经济法则强调结果公平、经济秩序 ,着眼于社会整体经济效益增进 ,通过实现社会整体效益最大化来实现对个别利益的一般保护。二者价值差异的根源在于经济思想基础、公平理念和利益观念的差异。二者价值体系在总体上具有一致性、谐和性和互补性。

Aming at raising particular transaction efficiency, civil law stresses equal opportunities and economic freedom and pursues individual interests as many as possible. Laying stress on improving economic beneficial results of the whole society, economic law emphasizes equal rusults and gives general protection to individual interests by increasing economic behefits of the society to a maximum. Differences in values beween economic law and civil law originate in their different theoretical basises of economy and different concepts of equality and interests. Systems of values of the two kinds of laws are consistent,harmonious and supply each other's needs.
