我国民事举证责任倒置范围较为窄狭 ,不能公正、合理地解决现代社会所带来的在诉讼中的一些新问题 ,因此 ,应适当扩大举证责任倒置范围。扩大的举证责任倒置范围可包括共同参与行为致人损害的侵权诉讼 ,妨害对方举证的行为。

In China the scope of inverted evidential burden is too narrow to meet the demand of the fast moving society and new legal problems from a modern society can not be solved with justice and fairness. Therefore it is necessary to enlarge the scope of inverted evidential burden.
