摘要
法律的良善性是法律内在的精神、理念 ,是法律成为法律的根据和前提 ,是法治的精神支柱。本文认为 ,良法是法律的形式良善性和实质良善性的统一 ,而法治就是形式良善性和实质良善性统一的良法之治。
The Leniency of law is its inherent spirit,which is the ground and prerequisite to make law be law. And the Leniency of law. is also the constitutionality spiritual prop. in this thesis the author regards kaw as the integration of the Leniency of law in form and in essence, and constitutionality as governing by law of that integration
