摘要
转租是市场经济中的普遍现象,它有放任主义、限制主义和区别主义三种立法模式,我国《合同法》采限制主义立法模式。无论是同意转租,还是自行转租,其法律效力问题均值予以明确。房屋转租中的优先购买权有顺位性,在其受到侵害时,应予以赔偿。
The legislative pattern of sublet has three forms: laissen-faire, restrictionism, distinction- ism. The Contract Law of China adopts the legislative pattern of restrictionism. The legal validity of both approved and unapproved sublet deserves theoretical clarification in the practice of Contract Law. The pre- emptive right of house sublet embodies its sequences. When it is infringed on, it should be redressed.
