The contradiction between the rapid development of electronic commerce and the stagnation of corresponding legislation makes the validating of the legal effect of electronic contract become the key issue of ensuring the safety of trade. How to fully use our country's decrees in effect to solve the problems concerning the main body, the seal and/or the signature, the safety of capital information and the undertaking of legal responsibility of electronic commercial contract is a presupposition of resolving the problem caused by the stagnation of legislation that hinders the steady development of electronic contract so as to ensure the condition of orderly development of new economy.
