医疗事故是指在诊疗护理工作中 ,因医务人员诊疗护理过失 ,直接造成病员死亡、残废、组织器官损伤导致功能障碍的后果等。必须依法确认各种具体的医疗事故 ,正确区分医疗责任事故与技术事故。凡发生医疗事故的 ,受害者不仅可以依法向医疗事故单位 (医院 )索赔 ,而且可以依法追究医疗事故单位的其他法律责任。

Malpractice is the consequence that directly causes the patients to be dead, disabled or functional disorder with the damaged tissue organs because of the faults of medical personnel when they make a diagnosis and give treatment of the patients or nurse the invalids.We must define various kinds of concrete malpractice according to law and distinguish correctly the malpractice and the skill accident. The victims can not only claim indemnity of the unit(hospital)which caused the malpractice but also find out the units other liabilities in law according to law as long as the malpractice has happened.
