论法治的现代化与政治的民主化

On Modernization of Rule by Law and Democratization of Politics

纵观人类法治发展的历史，法治的现代化过程也是政治的民主化过程。现代法治的本质是政治民主，民主政治是现代法治的政法基础。法治的现代化进程很大程度上取决于政治的民主化水平。我国的法治现代化与人民代表大会制这一根本民主政治制度密切相关。人民代表大会制度优越于“三权分立”，但还不完善。关注和建设社会主义法治国家，必须研究和加强社会主义民主政治的建设。

The development of rule by law in human history shows that the process of moderni- zation of rule by law is accompanied by democratization of politics. The nature of rule by law in modern times is democratic politics which is the political foundation of rule by law in contemporary age. The development of the modernization of rule by law is, to a great extent, determined by the development of the democratization of politics. The modernization of rule by law in our country is closely related to People's Congress which is the fundamental democratic political system of China. Though not so much perfect, the system of People's Congress is superior to that of the separation of the three powers ('tripartite' political system). It is necessary for us to study and strengthen the construction of socialist democratic politics in our concern about and construction of our socialist country to be ruled by law.
