论法治中的道德因素

Moral Factors in Rule by Law

法律与道德的关系是一个古老而常新的话题。本文在对中外有关主要理论观点加以综述之后 ,以马克思主义的基本观点为指导 ,论述了法治中存在一定道德因素的必然性 ,并从立法、执法。

This article starts with a general introduction to the major Chinese and foreign views on the relationship between law and morals. It then, with the guidance of Marxism agues that there is an inevitability of moral factors in rule by law and demonstrates the existing modes and functions of moral factors in enacting law, executing the law, administration of justice and observing the law.
