国家赔偿法存在问题刍议

On the Existing Problems in National Law of Restitution

国家赔偿法在实际运行中有许多不足 ,需加以修改。首先 ,在归责原则上要扩大国家赔偿主体的范围 ,减少法律前后矛盾 ,其次 ,在赔偿范围上要避免赔偿范围过窄问题 ,扩大受偿主体 ;再次 ,要实现科学的保障程序 ,使权利能顺利的实现 ,此外 ,在赔偿标准与赔偿数额等方面还有不足。

During the practical operations of National Law of Restitution,there are many insufficient aspects which need revising.Firstly,in imputation principles,we should broaden the subject limits of the national compensation and decrease the contradictions of the proceeding and following laws.Secondly,we should avoid the excessive narrowing aspects of the compensating limits and broaden the subjects of indemnification.Furthermore,we should realize the scientific guranteeing procedures and ensure the rights to be fulfilled.In addition,there are some insuffient aspects in compensating standards and quantity which needs to be solved.
