情节犯的立法完善

Legislative Perfection in Circumstance Crime

从我国刑法规定的情节犯立法形式上看 ,情节犯在立法上存在若干问题 ,应从以下几个方面予以完善 :第一 ,规范法律用语 ,保持法律条文的统一性 ;第二 ,在刑法附则中对“情节严重”等概念加以解释 ;第三 ,加强立法解释 ,限制司法解释。

In the legislative forms of circumstance crime in Chinese criminal law,there are some issues which should be perfected in the following aspects:firstly,standardize legal terms to keep legislative regulations in coherence;secondiy,interprete some concepts such as serious circumstances appearing in the notes appended to criminal law;thirdly,strengthen legislative explanation and limit judicial explanation.
